In these Terms and Conditions, the following terms shall have the meanings assigned to them below:

By accessing ph38.club, registering for an Account, or placing any wager on the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in full, together with ph38's Privacy Policy and Responsible Gaming Policy, each of which is incorporated by reference into these Terms.

If you do not agree to any provision of these Terms, you must immediately cease using the ph38 Platform. Your continued use of the Platform following any amendments to these Terms constitutes your acceptance of those amendments.

Access to and use of the ph38 Platform is restricted to individuals who satisfy all of the following eligibility requirements:

• Age: You must be at least twenty-one (21) years of age. ph38 strictly enforces this requirement consistent with PAGCOR's regulations governing online gaming in the Philippines. Registering or playing while under the age of 21 is strictly prohibited and will result in permanent account closure and forfeiture of any balance.
• Jurisdiction: You must be accessing the Platform from a jurisdiction where online gaming is lawful. It is your sole responsibility to verify the legality of online gambling in your jurisdiction before registering.
• Legal Capacity: You must have the full legal capacity to enter into a binding agreement and must not be subject to any court order or legal restriction preventing you from gambling.
• Self-Exclusion: You must not be subject to any active self-exclusion agreement, cooling-off period, or responsible gaming restriction that would prevent you from gambling, whether imposed by ph38 or by any other licensed gaming operator or regulatory authority.
• Single Account: You must not already hold an active ph38 Account. ph38 permits only one (1) Account per individual. Registration of multiple accounts is strictly prohibited.

To access real-money gaming features on the ph38 Platform, you must register for a ph38 Account. By completing the registration process, you represent and warrant that:

• All information provided during registration is accurate, complete, and up to date, including your full legal name, date of birth, residential address, and contact details.
• You will promptly notify ph38 of any changes to your registration information by updating your Account profile or contacting customer support.
• You are registering solely on your own behalf and not on behalf of any third party.
• You have not previously had an Account with ph38 that was suspended, restricted, or closed due to a breach of these Terms.

ph38 reserves the right to refuse registration to any individual at its sole discretion, without being required to provide a reason. ph38 may require you to submit documentary proof of your identity, age, and residential address at any time and at its discretion as part of ongoing KYC procedures. Failure to provide requested documentation within a reasonable period may result in temporary suspension of your Account and restriction of withdrawal functionality.

You are solely responsible for maintaining the confidentiality and security of your ph38 Account credentials, including your password and any two-factor authentication (2FA) codes. Specifically:

• You must not share your login credentials, password, or 2FA codes with any other person under any circumstances.
• You must not allow any third party to access or use your Account on your behalf.
• You must immediately notify ph38 if you suspect that your Account credentials have been compromised, that unauthorised access to your Account has occurred, or that your registered mobile number or email has been accessed by an unauthorised party.
• ph38 will never ask for your password via email, live chat, or SMS. Any communication purporting to be from ph38 that requests your password should be treated as fraudulent and reported to support immediately.

ph38 shall not be liable for any loss or damage arising from your failure to maintain the security of your Account credentials. ph38 reserves the right to treat all activity conducted through your Account as having been authorised by you unless you have promptly notified ph38 of a security compromise.

6.1 Deposits. ph38 accepts deposits via GCash, Maya (formerly PayMaya), GrabPay, QR Ph, InstaPay, PesoNet, BPI, BDO, Metrobank, 7-Eleven CLiQQ, Visa, and Mastercard. Minimum deposit amounts and processing times vary by payment method and are displayed in the Cashier section of your Account. All deposits must originate from a payment method registered in your own name. ph38 does not accept deposits from payment accounts belonging to third parties.

6.2 Withdrawals. Withdrawals may only be made to a payment method previously used to deposit funds into your ph38 Account and registered in your own name. Completion of KYC verification is a prerequisite for withdrawal access. ph38 reserves the right to conduct additional verification checks prior to processing any withdrawal, particularly for large withdrawal amounts or in cases of unusual account activity.

6.3 Currency. All transactions on the ph38 Platform are processed in Philippine Peso (PHP / ₱). ph38 bears no responsibility for any currency conversion fees or exchange rate differences applied by your payment provider.

ph38 may, at its discretion, offer bonuses, free bets, free spins, cashback, and other promotional incentives to Users. All bonuses and promotions are subject to the following general terms, in addition to any specific terms published with each individual offer:

• Bonuses are credited to your Account in a designated bonus wallet and are subject to wagering requirements before they can be converted to withdrawable funds. The applicable wagering requirement multiplier will be specified in the individual promotion terms.
• Unless stated otherwise, bonuses must be used within the validity period specified in the promotion terms. Unused bonus funds will expire and be removed from your Account without notice upon expiry.
• Bonuses are non-transferable and may not be exchanged for cash except where wagering requirements have been satisfied in full.
• ph38 reserves the right to withdraw any bonus offer, modify bonus terms, or reclaim bonus funds from a User's Account if it determines, in its sole discretion, that the bonus was claimed in violation of these Terms or through abuse of the promotional system.
• Only one bonus may be active at a time unless ph38 expressly states otherwise in the promotion terms.

8.1 Game Outcomes. All game outcomes on the ph38 Platform are determined by certified Random Number Generators (RNG) for non-live games, or by physical game equipment (cards, dice, roulette wheels) operated by human dealers for live casino games. ph38 does not manipulate game outcomes. All game RTP rates are consistent with those published by the relevant game provider.

8.2 Malfunctions. In the event of a game malfunction, system error, or network interruption that materially affects the outcome of a wager, ph38 reserves the right to declare the affected wager void and return the staked amount to the User's Wallet. ph38 shall not be liable for any additional compensation arising from a malfunction.

8.3 Minimum and Maximum Bets. Each game on the ph38 Platform has defined minimum and maximum bet limits. These limits are displayed within the game interface before placing a wager. ph38 may modify these limits at any time without prior notice.

8.4 Void Bets. ph38 reserves the right to void any wager where it determines that the wager was placed based on incorrect odds or prices resulting from a manifest error, system fault, or corrupted data feed.

The following conduct is strictly prohibited on the ph38 Platform. Any User found to have engaged in any of the following activities will have their Account immediately suspended or permanently closed, and any funds held in such Account may be forfeited:

• Multi-accounting: Registering or operating more than one ph38 Account, whether in your own name or using another person's identity.
• Identity Fraud: Providing false, misleading, or third-party identity information during registration or KYC verification.
• Bonus Abuse: Exploiting promotional offers through coordinated wagering, arbitrage, or any strategy designed to extract bonus value without genuine gameplay intent.
• Collusion: Cooperating with other players or third parties to gain an unfair advantage in any game, particularly in live poker or other competitive formats.
• Software Exploitation: Using automated scripts, bots, AI tools, or any third-party software to interact with the Platform in a manner not intended or authorised by ph38.
• Money Laundering: Using the ph38 Platform to process, layer, or conceal funds derived from illegal activities.
• Chargebacks: Initiating unauthorised payment chargebacks or reversals on deposits made to your ph38 Account.
• Harassment: Engaging in abusive, threatening, discriminatory, or otherwise inappropriate conduct toward ph38 staff or other Users via live chat, email, or any other channel.

ph38 is committed to promoting responsible gaming and to protecting vulnerable individuals, including those with gambling disorders. ph38 provides Users with the following responsible gaming tools, accessible directly from Account Settings:

• Deposit Limits: Users may set daily, weekly, or monthly limits on the total amount they are permitted to deposit into their ph38 Wallet.
• Loss Limits: Users may set limits on the maximum amount they are permitted to lose within a defined time period.
• Session Time Reminders: Users may configure notifications that alert them after a defined period of continuous play.
• Self-Exclusion: Users may voluntarily exclude themselves from the ph38 Platform for a defined period (minimum 7 days) or permanently. During a self-exclusion period, the Account will be locked and the User will not receive any marketing communications from ph38.

ph38 reserves the right to impose mandatory responsible gaming restrictions on any Account where it identifies signs of problematic gambling behaviour, regardless of whether the User has requested such restrictions. For more information, please visit our Responsible Gaming page.

All content on the ph38 Platform — including but not limited to the ph38 brand name, logo, website design, graphics, text, software, game interfaces, and multimedia content — is the exclusive property of ph38 or its licensed content providers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the ph38 Platform solely for your own personal, non-commercial gaming purposes in accordance with these Terms. This licence does not include the right to reproduce, distribute, modify, publicly display, scrape, frame, or commercially exploit any content from the ph38 Platform without the prior written consent of ph38.

To the maximum extent permitted by applicable law, ph38 shall not be liable to any User for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the ph38 Platform, including but not limited to:

• Loss of profits, revenue, or anticipated savings;
• Loss of data or corruption of data;
• Loss of business or business interruption;
• Platform downtime, technical faults, or service interruptions beyond ph38's reasonable control;
• Any act or omission of a third-party payment provider, game provider, or telecommunications carrier.

ph38's total aggregate liability to any User for any claims arising under or in connection with these Terms shall not exceed the total amount deposited by that User in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits ph38's liability for fraud, fraudulent misrepresentation, death or personal injury caused by ph38's negligence, or any other liability that cannot be excluded or limited under applicable Philippine law.

13.1 Closure by User. You may request the closure of your ph38 Account at any time by contacting customer support. Upon closure, any available balance will be processed for withdrawal to your verified payment method, subject to completion of any pending KYC requirements and subject to there being no outstanding investigations into the Account.

13.2 Closure by ph38. ph38 reserves the right to suspend, restrict, or permanently close any Account at its sole discretion, with or without prior notice, including but not limited to circumstances where:

• The User has breached any provision of these Terms;
• ph38 suspects fraudulent activity, money laundering, or criminal conduct;
• The User has provided false or misleading information;
• ph38 is required to do so by applicable law, regulation, or court order;
• ph38 determines that continued operation of the Account poses a risk to the integrity of the Platform or to other Users.

Where an Account is closed by ph38 due to a breach of these Terms, ph38 reserves the right to withhold any balance in the Account pending investigation. Balances in Accounts closed due to confirmed fraud or Terms violations may be permanently forfeited.

ph38 reserves the right to amend, modify, or update these Terms and Conditions at any time. Where amendments are material, ph38 will provide Users with reasonable advance notice via email to their registered email address, or via a prominent notice displayed on the ph38 Platform, or both.

Your continued use of the ph38 Platform after the effective date of any amendments constitutes your acceptance of the revised Terms. If you do not agree to any amended Terms, you must cease using the Platform and may request Account closure as described in Section 13.

The current version of these Terms is always available at ph38.club/terms-conditions. Users are encouraged to review these Terms periodically.

These Terms and Conditions and any dispute or claim arising out of or in connection with them — including non-contractual disputes — shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Dispute Resolution. In the event of any dispute between you and ph38 arising from your use of the Platform, we encourage you to contact ph38 customer support in the first instance at [email protected]. ph38 will endeavour to resolve disputes informally and promptly. If a dispute cannot be resolved informally, the parties agree to submit to the exclusive jurisdiction of the courts of the Republic of the Philippines.

Regulatory Complaints. ph38 operates within the regulatory framework established by PAGCOR for online gaming in the Philippines. Players who believe their dispute has not been resolved satisfactorily may escalate their complaint to the relevant regulatory authority.
